Biography
Lyndon Sommer, Registered CPA (Ill.) M.Acct., J.D., is a shareholder of Sandberg Phoenix & von Gontard. The majority of his work is in the areas of commercial and product liability litigation.

He has tried cases in federal and state courts in Missouri and Illinois. Lyndon has received jury verdicts on behalf of plaintiffs and defendants.

He has also argued multiple cases before the United States Courts of Appeal for the Seventh and Eighth Circuits, as well as the Illinois Appellate Court and Missouri Court of Appeals.

He has successfully represented clients in the accounting, aviation, agricultural and industrial equipment, transportation and road maintenance industries. In addition, he has defended product manufacturers in disputes with dealers and franchisees.

Lyndon specializes in defending certified public accountants in professional negligence cases. He has successfully defended accountants at trial and on appeal.

He has significant experience representing shareholders of closely held companies involved in shareholder disputes. Lyndon has spent a substantial amount of time in the past representing shareholders in trial courts and has argued several appeals arising out of shareholder litigation. These appeals have been argued in state and federal courts.

Lyndon has significant experience representing plaintiffs and defendants in cases where a party is seeking an injunction. He has represented clients seeking and objecting to the entry of temporary restraining orders. He has enforced clients’ non-compete provisions contained in employment agreements and obtained damages from employees violating non-compete agreements.

A sampling of Lyndon’s experience includes:
Adams v. Missouri Highway and Transportation Commission, et al. Lyndon defended a highway technology company which provided traffic control devices for a large highway project. Plaintiffs filed wrongful death and personal injury suits against 13 defendants. Plaintiffs claimed Lyndon’s client failed to install appropriate traffic control devices. Plaintiffs’ lost wage claim exceeded $10 million.

Hill v. Missouri Highway and Transportation Commission, et al. This case was consolidated for trial with the Adams case listed above. Plaintiffs filed a wrongful death claim against Lyndon’s client. The Adams and Hill cases were tried in St. Louis City.

Robinson v. Safe-T-Flare Services, Inc. In this wrongful death case, Lyndon represented a company which installed and inspected traffic control devices on the road construction project.

JTC v. Koch Materials, et al. In this anti-trust lawsuit, Lyndon defended a company which provided road maintenance services. Plaintiff alleged Lyndon’s client engaged in a conspiracy to restrict competition for government contracts awarded to companies which do work for road districts. This case was argued in the United States Court of Appeals for the Seventh Circuit in front of Judges Posner and Easterbrook.

Witters v. Hicks. Lyndon represented Mr. Hicks in this contentious shareholder action. The case involved numerous days of evidentiary hearings in front of the trial court over the span of a few years. It also resulted in numerous appeals in federal and state court.

Hynes & English v. Empire Electric, et al. In this product liability action, Lyndon represented the distributor of a scaffolding. Plaintiffs were injured when they were moving the scaffolding on a large job site. A co-worker was moving the scaffolding with a forklift and the plaintiffs were holding the scaffolding while it was being transported. The plaintiffs suffered severe electrical shock and are disabled. Plaintiffs alleged the scaffolding was defective because it lacked sufficient warnings.

Odom v. Genie, et al. Lyndon defended a highway equipment distributor in this wrongful death litigation. The plaintiff claimed that a manlift was defective and unreasonably dangerous. Plaintiff also made separate allegations of negligence against the distributor.

St. Louis Ceiling & Tile v. Surti. Lyndon defended a certified public accountant in this malpractice action. It was alleged the accountant improperly compiled financial statement for plaintiff.

Lyndon is admitted to practice law in Missouri and Illinois. He is also a Registered Certified Public Accountant in Illinois.

Lyndon is a member of the Professional Liability Underwriting Society, the Missouri Society of CPAs and a member of the American Association of Attorneys/Certified Public Accountants.
 
Lyndon is a member of the Missouri Bar, the Bar Association for Metropolitan St. Louis, the Lawyers Association, the St. Clair County Bar Association and the East St. Louis Bar Association. In addition, Lyndon is a member of the executive committee of the Lawyers Association. He actively participates in bar association activities.

Publications
Before he began practicing law, Lyndon authored numerous tax articles which were published in legal and accounting journals. In addition, he wrote the first chapter of a book entitled, "How to Deal with the IRS."

Education
Lyndon earned his Juris Doctor at Southern Illinois University School of Law in 1992, where he was the Editor in Chief of the Southern Illinois University Law Journal.
 
Lyndon earned a Masters degree in Accountancy in 1989 and a B.S. in Accounting, in 1987 from Southern Illinois University, Carbondale.
