Biography

With nearly a decade of experience in business litigation, Katrina Smeltzer focuses her legal work on matters involving:

  • Insurance coverage analysis and litigation
  • Bad faith litigation
  • Non-medical professional liability litigation

Katrina also has significant experience in appellate matters and has represented companies ranging from large insurance providers to small engineering firms.

Having practiced in four major metropolitan areas and held active bar licenses in six states, Katrina brings a broad range of experience to her work with clients in Kansas City and throughout the Midwest and a deep understanding of the business issues and dynamics inherent to her areas of practice. This exposure to different legal environments, procedures, courts and plaintiff/defendant mix provides her unparalleled perspective on issues facing her clients, better preparing her to provide the highest quality legal advice.

In her time away from the office, Katrina raises her three small children and loves cooking, baking and discovering new foods. She’s also a fan of reading, particularly historical fiction.

Background

Katrina received her Bachelor of Arts, magna cum laude, in Political Science and Juris Doctor, also magna cum laude and a Certificate of Concentration in Litigation from Creighton University. During her tenure at Creighton University School of Law, she was an Associate Staff member of the Creighton Law Review.

Katrina is a member of the Kansas City Metropolitan Bar Association, the Kansas Bar Association, the Missouri Bar Association, the Federal Bar Association, Missouri Organization of Defense Lawyers, and DRI. She is licensed to practice law in Missouri, Kansas, Illinois, Iowa, Nebraska and Minnesota (currently inactive).

Matters

Katrina obtained summary judgment in favor of her client in a case pending in the District Court of Lane County, Kansas involving the interpretation of a trust document prepared in the 1970s. The judge agreed with the interpretation advocated by Katrina, and ordered judgment in favor of her client and other defendants.

Katrina assisted in obtaining dismissal of a case brought against our insurance company client federal district court in which coverage for repair costs following a fire were in dispute. The case was dismissed by the insured following preliminary discovery.

Katrina assisted in obtaining a favorable outcome for our insurance company client in a federal district court case in which claims for bad faith failure to settle and vexatious refusal were asserted. The case involved several issues of unresolved Missouri law in the areas of bad faith and vexatious refusal against an insurer, and resolved before trial.

Katrina Smeltzer joined Sandberg Phoenix’s Kansas City office in 2015, coming from another large Midwestern law firm and bringing more than eight years of legal experience to the Business Litigation Practice Group. She focuses her legal work on civil litigation, including professional and premises liability, insurance coverage and bad faith matters. She is also highly experienced in appellate work, and has represented companies ranging from large insurance providers to businesses in the hospitality and telecommunications industries.

“Sandberg Phoenix provided me a great opportunity to focus my legal practice and develop a large network here in Kansas City,” Katrina says.
