Biography

Andrew R. Kasnetz is a shareholder of Sandberg Phoenix & von Gontard. He focuses his practice in the area of business litigation. He has handled a wide variety of contract and business tort matters including shareholder disputes, commercial fraud, employment, construction, real estate, manufacturing and distribution, banking and software development. Andy has vast trial and appellate experience and has successfully litigated cases in state and federal courts in many jurisdictions including Missouri, Illinois, Kentucky, South Carolina, Colorado, California, New York and Washington.

Prior to joining Sandberg Phoenix, Andy was formerly a partner and founding member of Davis, Davis, Kasnetz & Greenberg. Before beginning the practice of law in 1982, he was Judicial Law Clerk to the Honorable John M. Karns, Jr, Illinois Appellate Court, and Fifth Judicial District from 1981-1982.

After years of participating as an advocate in mediations, Andy has recently completed comprehensive training to begin serving as a mediator. He has begun his practice in this area and intends to continue to do so in addition to his trial practice.

In recognition of his outstanding service to clients in the area of Commercial Litigation, Andy has been named a Best Lawyer in America from 2015 to 2017.

Andy is admitted to practice law in Missouri and Illinois.

He is a member of the American Bar Association, the Missouri Bar Association and the Bar Association of Metropolitan St. Louis.

Andy has served as a speaker/lecturer at numerous legal and professional programs on the subjects of trial practice, bank litigation, bankruptcy and family law.

Education
Andy earned his Juris Doctor, cum laude, from Saint Louis University School of Law in 1981.

He earned his B.A. at the University of Kansas in 1978.

Successes

A sampling of trials and appeals handled by Andy include:
Bunzl Distribution v. Borden Industries-United States District Court, Eastern District of Missouri. Andy obtained defendant’s verdict for the client in $500,000 case involving corporate rebates and pricing issues.

Kennedy v. Fournie, et al.-Circuit Court of the City of St. Louis. Andy represented defendant/ counter-claimants in multi-million dollar dispute among the shareholders in a closely held corporation.

Beiser v. Hensic-Missouri Court of Appeals. Andy successfully represented landowners in establishing a right-of-way by adverse possession.

Ford v. Manlin Co., et al.-Circuit Court of St. Louis County. Andy obtained defendant’s verdict in case involving alleged defects in the construction of a home and related fraud claims.

Peterson v. Continental Boiler Works-Supreme Court of Missouri. Andy obtained reversal in a case involving a dispute with former employees and minority shareholders regarding breach of a stock restriction agreement. The case set the standard in Missouri for recovering of punitive damages in breach of contract cases.

Sisk v. Polar Corporation-Circuit Court of St. Genevieve County, Missouri. Andy successfully defended property damage and a breach of commercial lease action.

Hoyt V. G.E. Capital Mortgage Services, Inc., et al.-Circuit Court for the City of St. Louis, State of Missouri. Andy obtained a verdict for client in action for breach of contract, tortious interference with credit expectancy and defamation.

M&P Enterprises v. Transamerica Financial Services-Supreme Court of Missouri. Andy obtained affirmance on behalf of the lien holder in a case involving due process rights in the redemption of real property.
