<description>J. Thomas Long was granted Motion for Summary Judgment for defendant in Shevlin v. Bond County.Plaintiff Ron Shevlin filed suit against Bond County, Illinois, alleging the redistricting/reapportionment map passed by the County Board was invalid due to an error in the map. Plaintiff claimed the error in the map caused it to no longer comply with the statutory requirements for a reapportionment map and asked the court to invalidate the map. Plaintiff then filed a Motion for Summary Judgment and Motion for Declaration of Rights and attached an affidavit of an expert stating there were other, better reapportionment maps that could be drawn.  Tom Long argued in opposition that the original map, even with the error, sufficiently complied with the statute and was passed by valid legislative process. Further, Plaintiff failed to propose a remedy. Mr. Long on behalf of Bond County filed a Cross Motion for Summary Judgment supported by Depositions and the Affidavit of Mr. Brock Willeford, the Bond County Board Chairman.  After argument, the Court ruled in favor of Bond County, denying Plaintiff's Motion for Summary Judgment and granting Bond County&#8217;s Cross Motion for Summary Judgment.</description>

<description>Revisiting Relation Back and "Doe" Defendants  The principle of relation back and misnomer can be confusing. In a recent Supreme Court of Missouri case, State ex rel Holzum v. Schneider, the Court clarified a line of cases that have applied Missouri Rule 55.33(c) and the common law &#8220;misnomer&#8221; doctrine. The Court found plaintiff&#8217;s amended petition did not relate back for limitations purposes to the initial petition that relied on &#8220;Doe&#8221; defendants. 342 S.W.3d 313 (Mo. Banc. 2011). Health care providers should be aware that plaintiffs&#8217; attorneys may effectively utilize &#8220;John Doe&#8221; designations in their pleadings; however, there are strict parameters. We recently relied on Holzum to obtain a dismissal for a defendant hospital originally named as a &#8220;Doe&#8221; and not served for approximately six years after the filing of the original petition.

<title>Sandberg Phoenix Attorneys Obtain
Defense Verdict in Tragic Wrongful Death Case</title>

<description>On November 9, 2011, Sandberg Phoenix &amp; von Gontard P.C. attorneys, Stephen M. Strum and David Z. Hoffman, obtained a defense verdict before Judge Robert Koffman in Pettis County, Missouri.  The jury trial lasted eight days and involved the crushing death of a 56 year-old over-the-road truck driver.  Immediately before his death, the decedent was standing between another tractor-trailer and a loading dock. Mr. Strum and Mr. Hoffman represented Cooperative Workshops, Inc. (CWI).  One of CWI&#8217;s mentally-challenged employees allegedly instructed the tractor-trailer driver that he had permission to back up. Upon backing up, the tractor-trailer pinned the decedent to the loading dock, causing his death. The main theories against Mr. Strum and Mr. Hoffman&#8217;s client included a vicarious liability claim, alleging that the mentally-challenged employee told the tractor-trailer driver he had permission to back his truck when it was unsafe, and that the employee was not properly supervised by CWI&#8217;s staff.  The plaintiffs were the widow, two adult children, and 92 year-old mother of the deceased. The economic losses were approximately $1 million, and plaintiffs' counsel asked the jury for an award of $4.5 million. The jury ultimately determined the decedent was 100% at fault for his own death.</description>

<description>Illinois State Superintendent of Education Dr. Christopher Koch announced that former United States Attorney A. Courtney Cox and the law firm of Sandberg Phoenix &amp; von Gontard have been retained by the Illinois State Board of Education to conduct an investigation into allegations of waste, fraud and financial mismanagement with respect to Illinois School District 189, including District Charter Schools.     Cox and the firm will report findings of the investigation to the Illinois State Board of Education, render advice with respect to the investigation, and perform other duties as directed by ISBE. Cox and the firm will also take appropriate legal action, including litigation, as warranted by the evidence and defend legal actions which may be brought, at the direction of the ISBE.  The initial stage of the investigation will include five specific areas of interest: Contracts for Goods and Services and Leases, District Personnel, District Consultants, Inventory and Expenditures, and Grants. The investigation will include a complete and in-depth review of all finances and personnel decisions of the District since the end of the previous ISBE oversight of the District in 2004.     Cox previously served as United States Attorney for the Southern District of Illinois from November 2007 through August 2010. He joined Sandberg Phoenix &amp; von Gontard as a shareholder in September 2010. <description>Like most states, the State of Illinois has adopted its own statutory prohibition against discrimination in the workplace, the Illinois Human Rights Act.  Because a charge of discrimination filed against an Illinois employer is typically deemed to be filed with both the EEOC and the Illinois Department of Human Rights (&#8220;IDHR&#8221;), EEOC and IDHR will coordinate responsibility for which agency should take the lead in investigating the charge.  In those instances when the IDHR takes the lead and investigates the charge, ultimately the EEOC will simply adopt the IDHR finding as its finding and will administratively terminate and close its file without conducting a second investigation.  Where the EEOC initially investigates the charge, IDHR unfortunately did not see the logic or wisdom in such an approach and does adopt the EEOC determination as its own and, in many instances, insists on conducting a second investigation concerning the same allegations that the EEOC had reviewed and, in most instances, concluded lacked merit.  In light of the obvious burden and expense, in both time and dollars, businesses found such duplicative investigations to be unnecessary and a waste of not only the employer&#8217;s resources but, ultimately, the finite resources of the State of Illinois.  Sandberg Phoenix partner, Thomas E. Berry, is a member of the Employment Law Council to the Illinois Chamber of Commerce, which serves as an intermediary between business interests and state administrative officials, such as the IDHR, as well as the state legislators.  The Employment Law Council was successful in obtaining passage of Senate Bill 1122 which, when signed into law by Governor Quinn, will amend the Illinois Human Rights Act to authorize IDHR to now adopt the findings of the EEOC without going through a second investigation concerning the same allegations of discrimination or retaliation.Along with other members of the Employment Law Council, Tom assisted in the enactment of Senate Bill 1122 by not only preparing and submitting proposed language to the legislative sponsors of SB 1122, but also assisted in negotiating the language of the Bill with other interested stakeholders, included representatives from both the IDHR and the Illinois Human Rights Commission, and working with the leadership in the Senate and House to achieve passage of this commonsense and practical based reform to the Illinois Human Rights Act. </description>

Phoenix attorneys Todd Stanton and Tim O&#8217;Leary were granted summary judgment in
a declaratory judgment action filed in the Circuit Court for St. Clair County,
Illinois.


The plaintiff, an Illinois resident, was a
passenger in a rented motor vehicle which was involved in a single vehicle
accident in Vermont.
The driver lost control of the vehicle, causing it to leave the roadway and
rollover. The plaintiff sustained extensive personal injuries. After settling
with the driver&#8217;s insurance carrier, the plaintiff made a claim against his
employer&#8217;s insurance policy for underinsured motorist coverage, ultimately
filing a declaratory judgment action seeking a declaration the policy afforded
him coverage. The insurer argued the policy did not provide UIM coverage for
rented vehicles, and moved for summary judgment on that ground. 
The
Honorable Judge Stephen McGlynn of the St. Clair County Circuit Court granted
the defendant insurer&#8217;s Motion for Summary Judgment on the issue of UIM
coverage and made the further finding that there was no coverage under the
general liability provisions of the policy.</description>

<description>VICTORY FOR HOSPITALS - 3/24/11 -Illinois Supreme Court ruling protects hospital liens

In Wendling v. Southern Illinois Hospital Services, the Illinois Supreme Court upheld longstanding caselaw that the &#8220;common fund doctrine&#8221; is inapplicable to health care liens. 2011 WL 1085186 (Ill., March 24, 2011). In doing so, the Court reversed two lower court decisions that, if followed, could have proven costly to health care providers. As a result of Wendling, when dealing with lien adjudication, health care providers do not have to fear the need to reimburse plaintiffs&#8217; attorneys for their fees under the common fund doctrine because it is inapplicable.

Each year, the Sandberg Phoenix &amp; von Gontard Charitable Foundation, Inc. (a 501(c)(3) organization) supports and contributes to several local, regional, and national charities selected by the firm's Charitable Efforts Committee. Funding for these organizations comes from a variety of events hosted by the firm, such as bowling tournaments, casino nights, sand volleyball competitions, jeans days, bake auctions, holiday luncheons, and other special events.

For 2010, the firm chose The Bridge, Foundation Fighting Blindness, St. Louis Challenger Baseball, and HavenHouse St. Louis as its primary charitable beneficiaries, and donated $12,846 to those organizations. In addition, the firm&#8217;s members pledged $22,068 to the United Way and gave approximately $2,700 to several other organizations in the area. The firm also underwrote all expenses (about $10,000) needed to raise the above funds, so that 100% of receipts could go directly to the organizations benefited.
Tim Sansone, who chairs the firm&#8217;s Charitable Efforts Committee, credits the members of his committee, as well as the firm&#8217;s staff and attorneys, for their support: &#8220;Despite the economic downturn, the members of Sandberg Phoenix continue to volunteer their time and donate their earnings to help those in need. It&#8217;s so refreshing to have this unwavering support.&#8221;

Nexgrill product liability case.In this case, a fire occurred at the plaintiffs' home in Cedar Hill, Missouri, on August 24, 2006. Plaintiffs alleged the fire was caused by a defect in the routing of a propane hose on their barbecue grill manufactured by Nexgrill.Nexgrill successfully moved to strike the testimony of the plaintiffs' mechanical engineer for conducting faulty experimentation, and to limit the testimony of plaintiffs' fire investigator and electrical engineer to the issue of the fire's cause and origin. Nexgrill then sought and obtained summary judgment, arguing plaintiffs' lack of a defect expert precluded them from proceeding.Plaintiffs appealed the striking of their mechanical engineer and the granting of summary judgment in favor of Nexgrill. The Eighth Circuit found no reversible error and affirmed the lower court's rulings.</description>

Lading, Courtney Cox and Tony Martin, on behalf of the Illinois Civil Justice
League, the Washington Legal Foundation, and the Allied Educational Foundation,
leading national public policy institutions, have recently been granted leave
to file an amicus brief with the Illinois 1st
District Appellate Court in opposition to a recent jury award in Cook County, Illinois.
Plaintiff Dominic Choate was
injured in July 2003 when he attempted to jump onto a moving freight train in
his hometown of Chicago Ridge, Illinois. Choate, who was nearly 13 at the time of the
accident, testified that despite his knowledge of the riskiness of his actions,
he nevertheless attempted to jump onto a moving freight train out of a desire
to impress his girlfriend. Plaintiff did
not allege that the train was operated in a negligent manner at the time of the
accident; rather, his theory of recovery was that the Defendants should have
done more to prevent him from engaging in such risky behavior.
Choate filed suit against
Burlington Northern Sante Fe Railroad (operator of the train), CSX
Transportation, Inc., (the owner of the tracks), Indiana Harbor Belt Railroad
Co. (which patrolled the railroad right-of-way), and the Baltimore and Ohio
Chicago Terminal Railroad Co. At trial,
Plaintiff conceded that he was trespassing on the railroad tracks at the time
of his injury, and that in general landowners owe no duty of care to those who
trespass on their property. Plaintiff
nonetheless contended that Defendants were liable for his injuries because: (1)
they were aware of a &#8220;dangerous condition&#8221; on the railroad property &#8211; moving
freight trains that individuals would want to jump onto; and (2) children are
likely to be injured while attempting to jump onto the trains because they are
incapable, in light of their age and maturity, of appreciating the risk
involved. At trial, Plaintiff&#8217;s
attorneys argued that even though the Plaintiff admitted he knew what he was
doing was extremely dangerous, his admission was irrelevant, and that the jury
should focus on the knowledge of the typical child of Plaintiff&#8217;s age, and not
the actual knowledge of the Plaintiff himself. The trial court, after initially granting summary judgment to the
Defendants, reversed itself, holding that the obviousness of the dangerous
condition should be left to the jury to decide. At trial, the jury found in favor of the Plaintiff on liability, and
awarded Plaintiff $6.5 million in damages.

This verdict, and the court&#8217;s application
of the law to allow this matter to proceed to verdict, represents a departure
from, and substantial expansion upon, existing Illinois premises liability law. In the words of Judge Alex Kozinski, Chief
Judge of the U.S. Court of Appeals for the Ninth Circuit, &#8220;Just as imposition
of liability tends to discourage undesirable behavior, the payment of a subsidy
tends to encourage it. When we pay
damages to a plaintiff who bears substantial responsibility for the harm he
suffered, we send a message to him and to others like him that taking care of
your safety is not your responsibility but someone else&#8217;s.&#8221;

The employer's position was that the employee was physically unable to perform the essential lifting functions of his job due to his medical condition and his doctor's restrictions. After a lengthy EEOC investigation, the EEOC filed suit. After discovery closed, the employer moved for summary judgment. Judge Limbaugh in the United States District Court for the Eastern District of Missouri granted the motion and awarded a judgment in favor of Sandberg Phoenix's client.</description>

Each year, the Sandberg Phoenix &amp; von Gontard Charitable Foundation, Inc. (a 501(c)(3) organization) supports and contributes to several local, regional, and national charities selected by the firm's Charitable Efforts Committee. Funding for these organizations comes from a variety of events hosted by the firm, such as bowling tournaments, casino nights, sand volleyball competitions, jeans days, bake auctions, holiday luncheons, and other special events.
In 2009, the firm selected Ride On St. Louis, Hospice of Southern Illinois, Inc., Community Women Against Hardship, and Sunshine Ministries as its primary charitable beneficiaries, and donated $12,242.60 to those organizations. In addition, the firm&#8217;s members pledged over $20,000 to the United Way and gave approximately $4,500 to several other organizations in the area. The firm also underwrote all expenses (about $10,000) needed to raise the above funds, so that 100% of receipts could go directly to the organizations benefited.
Tim Sansone, chair of the firm&#8217;s Charitable Efforts Committee, said he is &#8220;always amazed&#8221; at the generosity of his colleagues. &#8220;They&#8217;re ready to give their time or open their wallets even in tough economic times. <description>Niedbalski v. Bell Sports involved a bicyclist who was struck by a vehicle while returning to his hotel in St. Louis. Plaintiff alleged a defective helmet failed to protect his head when he fell to the pavement, causing catastrophic, life-altering injuries. The case was tried in July 2007 and the jury returned a defense verdict.

On appeal, plaintiff argued the trial court committed reversible error when it (1) failed to give a jury instruction that would have been more favorable to him; (2) allowed evidence and argument related to how the accident happened, which may have suggested he was negligent; (3) did not allow one of his family members to introduce hearsay while testifying; and (4) allowed "speculative" testimony about what happened to the helmet after the collision, while not allowing an ambulance record supposedly showing he was helmeted after the collision.

The Court of Appeals rejected all of plaintiff's arguments, and affirmed without a published opinion. The case was argued on September 9 and decided on September 23.</description>

The owner's position was that it was raining heavily outside and the water on the floor was tracked in rain water; therefore, under the Illinois natural accumulation rule, the owner had no duty to clean up the tracked in rainwater and was not liable for plaintiff's alleged injuries as a result of the fall. After discovery closed, the owner filed a Motion for Summary Judgment. Judge Morris in Saline County, Illinois granted the motion and awarded a judgment in favor of Sandberg Phoenix's client.</description>

Sandberg Phoenix &amp; von Gontard P.C. associate, Jennifer Miller-Louw, tried her first solo jury trial in Jackson County and received a defense verdict in favor of the premises owner.

The Plaintiff alleged that she fell on a curb ramp outside the owner's premises, due to a wet and slippery area. The curb ramp was in excellent condition, but the plaintiff complained that the surfaces were not level where the concrete and pavement met. Ms. Miller-Louw took the position for the defense that the plaintiff fell due to freshly fallen snow and ice on a well maintained and designed curb ramp, and thus, pursuant to Illinois law, the premises owner was not liable.

Ms. Miller-Louw moved for a directed verdict at the close of the plaintiff's case, and the court granted the motion and entered judgment in favor of the owner. The court determined that there was no duty to assure that the two surfaces had to be level where they met and that the differences in the levels were minimal and did not constitute an unreasonable risk of harm. Moreover, the court ruled that the plaintiff failed to prove that the snow and ice was an unnatural accumulation, a prerequisite to recovery. Therefore, the court found that the premises owner could not be liable to the plaintiff for the fall.</description>
